Criminal Defense

The California criminal justice system is the largest in the country, but that does not make it the best. In fact, the term “system” accurately reflects the process of moving defendants quickly through established procedures that are intended to lead to a conviction. The major stages of the criminal justice system are arrest, prosecution, and corrections. At Davis & Wojcik, we believe in another stage – a fair trial.

Every defendant has rights, including the right to an attorney. Any person who stands accused of a crime should exercise his or her right to an attorney to ensure that other rights are not violated or unknowingly waived. The criminal justice system is complex but a Temecula or Hemet criminal lawyer at Davis & Wojcik can help navigate through this difficult process.

In the eyes of the criminal justice system, defendants are nothing more than a police report and case number. At Davis & Wojcik, our goal is to show that our clients are human beings with rights. We provide a voice for your side of the story and deliver proficient representation regardless of the circumstances. At Davis & Wojcik, our clients are still “innocent until proven guilty.”

If you or a loved one have been accused of a crime, the systematic process has already begun, and immediate legal representation should be sought. The Temecula and Hemet criminal lawyers of Davis & Wojcik handle all types of criminal cases—felony, misdemeanor, and juvenile delinquency.

Have you been accused of a probation violation? Did a violation of your Fourth Amendment rights lead to serious drug charges? Are you seeking an expungement of a previous criminal charge, so you can qualify for employment, housing or security clearance?

Our full-service leadership can benefit a broad range of clients facing felony and misdemeanor charges. But we need to hear from you now, so the hard work of protecting your rights can begin. Most Frequently Charged Crimes

Domestic Violence

According to the Department of Justice, there were over 7,219 domestic violence-related calls for assistance made in Riverside County during the year of 2022. Domestic violence goes beyond “spousal abuse” and includes abuse or threats of abuse between any persons in an “intimate relationship,” including persons related by blood or marriage. “Abuse” has a similarly broad definition and can include physical contact, throwing objects, intimidation, following, or preventing a person from freely coming and going. Abuse can also be verbal (spoken), emotional, or psychological.

In other words, domestic violence claims can arise from any number of situations – which often occur outside the presence of witnesses. In addition, law enforcement agencies in California implement a “mandatory arrest policy” for domestic violence. This means that, if law enforcement responds to a domestic violence call, someone is going to be arrested in order to defuse the situation. Once an arrest occurs, the accused is left to navigate his or her way through the criminal justice system.

If this as happened to you, there is no time to waste. Contact a Temecula or Hemet domestic violence lawyer from Davis & Wojcik immediately by calling (951) 587-2222 . You can also secure an appointment by email message.

Driving Under the Influence

It is illegal to operate a vehicle with a Blood Alcohol Content (BAC) of 0.08% or higher, if the person is 21 years old or older. If the person is under 21 years old or on a DUI probation, the BAC must not be higher than 0.01%.

In California, “under the influence” also applies to medications, regardless of whether illegal drugs are involved. DUI convictions stay on your driving record for 10 years. Drug Possession

Being charged with Possession of a Controlled Substance does not require that the accused be holding the drugs. A person can also be charged if the drugs are found in a place within the person’s control or in “joint possession” with another person.

The crime of drug possession can be increased to a felony if the prosecutor can prove an intent to sale. This can be proved by the presence of scales, cash, or large quantities of the drug in separate packaging.

If you have been arrested for drug possession or a related crime, contact Davis & Wojcik immediately by calling (951) 587-2222 . You can also secure an appointment by email message.

Sex Crimes

Sex crimes can range from misdemeanor prostitution and statutory rape to felony child molestation and rape. Most sex crimes result in being required to register as a sex offender.

Many innocent individuals are accused of sex crimes that are either false or occurred under circumstances that are misconstrued. A Temecula and Hemet criminal lawyer at Davis and Wojcik understands that reported crimes are not the same as actual crimes and will provide a vigorous defense.

If you have been arrested for a crime involving a sexual allegation, contact Davis & Wojcik immediately by calling (951) 587-2222 . You can also secure an appointment by email message.
